Noida Extension: wait and watch [23rd July 2010, Hindustan Times]

 
Though Allahabad High Court's hearing on the Greater Noida land cases has been deferred to July 26, buyers are keeping their fingers crossed hishir Gupta booked a flat in Supertech's Eco Village II last year.

After the Supreme Court verdict on Shahberi a fortnight ago, he requested the builder to provide him alternative accommodation in the Meerut project but was informed that everything was booked. The decision of the Allahabad High Court to scrap land acquisition of 589.13 hectares in Patwari village has added to his worries. Gupta is now exploring the option of moving to a project by the same developer at Crossings Republik.

He is even willing to pay more for it. For him, options are limited and cash is a worry -no refund is in sight either.

Homebuyers, clueless about the fate of their properties with the quashing of the land acquisition in Greater Noida, have now moved the court seeking relief.

Rahul Sharma of The Noida Extension Flat Buyers Welfare Association (NEFBWA) says, “We have appealed to the court for a hearing before taking a decision on the Noida Extension petition. We wish to participate in the course of judgment so that the relief due to homebuyers is recorded in the judgment and our grievances can be heard before the final verdict.“

Over 20,000 people and 11 developers have been impacted by the order on Patwari village and 10,000 by the order on Shahberi village. The court has deferred its hearing on the petitions filed by farmers of RozaYakubpur village in Gautam Budh Nagar district, who had challenged the acquisition of 468 hectares of land by the state government in 2007-2008 till July 26. Other petitions have been filed by farmers of Bisrakh, Jalalpur, Haibatpur, Iteda, Ganghela and others. All these cases will be heard on Tuesday.

What's the way out for buyers?

They will have the legal recourse option if the Noida Extension project is scrapped in its entirety or if the builder refuses to refund the amount with interest. Also, since some projects had to be cancelled due to the Supreme Court's decision in the Shahberi village case and more will be cancelled subsequent to the recent decision, the buyers may not have the option to relocate to another project if the builder does not have any other offering
